PS: Diese Domains und weiere wurden auch ursprünglich mal für CMSimple (-Partnerschaft) registriert und sind dann zu CMSimple_XH "mitgenommen worden", wenn ich es auf die Spitze treiben würde, würde ich auch noch cmsimpleforum.com und cmsimplewiki.com mit einbeziehen.
Na ja, die Board-Domain hattest Du ja unter der Hand schon einmal angefragt...

Hi all

Please considder the Danish marketing laws which may have some influence on your wanting to spend money on lawers.
It is against the law (huge penalties) to mislead the consumer (end user)!

If anyone means anything with CMSimple being simple - small - smart as stated under the still available CMSimple version 3.4, then CMSimple version 4 is misleading the consumer as it is based upon CMSimple_XH 1.5.3 (CMSimple_XtreemHeavy 1.5.3).

Hallo zusammen,
als 'Außenstehender' vielleicht zuerst einmal: warum bin ich hier gelandet und warum gebe ich hier einen Beitrag dazu? Ich benutze seit langem cmsimple und bin vor einiger Zeit zu cmsimple_xh gewechselt. Ich arbeite sehr gerne damit, es liefert genau das, was ich brauche. Ich erwarte, dass es weiterentwickelt wird (das war ein Grund, zu cmsimple_xh zu wechseln). Denn nur so kann es den aktuellen Anforderungen angepasst werden.
Seit einiger Zeit bin ich aber wirklich irritiert: was ist denn nun die aktuelle Version von cmsimple_xh? Wird daran weitergearbeitet? Oder sollte ich zu cmsimple zurückwechseln (ist ja schließlich jetzt eine Weiterentwicklung von cmsimple_xh 1.5.3)? Für mich als Außenstehenden is es irritierend, das cmsimple_xh.de und cmsimple_xh.com auf cmsimple.org weitergeleitet werden. Es hat damit zuerst einmal den Anschein, als ob cmsimple_xh gar nicht mehr existiert und in cmsimple.org aufgegangen ist. Bei genauerem Hinsehen ist dann doch auch noch cmsimple_xh zu finden (cmsimple-xh.org mit cmsimple_xh Version 1.5.5). Also m.E. kann die Verwirrung für einen Außenstehenden gar nicht viel größer werden.

Ich habe jetzt nicht alles gelesen, es ist aber leicht zu bemerken, das es Streitigkeiten innerhalbt der aktiven Community gibt. Im Sinne der Sache solltet ihr möglichst bald eine Einigung finden. Dafür gibt's sachlich gesehen zwei Möglichkeiten: (1) cmsimple und cmsimple_xh werden deutlich von einander getrennt (inkl. Domains). (2) cmsimple und cmsimple_xh verschmelzen komplett. Mein Votum ginge aus sachlichen Gründen zu dem letzteren. Es macht m.E. mehr Sinn, gemeinsam an cmsimple weiterzuarbeiten (die diesbezüglich Aktiven sind ja nun auch nicht so zahlreich). Alle Aktiven würden voneinander profitieren. Bei einer Spaltung, und so sieht es ja momentan aus, muss ich mich als Außenstehender für eins von beiden entscheiden. Ich persönlich würde mich immer für die größere aktive Community entscheiden (nach meinem Kenntnisstand also für cmsimple_xh), da dann zu erwarten ist, dass die Software besser gepflegt wird.

Neben den sachlichen Gründen spielen offensichtlich auch noch andere Dinge eine Rolle. Welche genau, kann ich nicht sagen, aber die Uneinigkeit, die in den Postings zu finden ist, offenbart sie. Wie damit umzugehen ist, dazu kann ich natürlich nichts sagen.

Acctually I don't ;-) I just tell you all, that everybody has the right to use the name CMSimple if the want to. That is the result of using GNU GPLv3.

You and I would have solved this small problem very easy if you just had ask me in a nice and friendly manner. But in stead you tried to force me with some self inventet legal mumbo jumbo which is clearly in conflict with the terms in GNU GPLv3. This is not the way you solve problems with me.

So until we have a solution all can agree to I will use the name CMSimple exactly as it pleases me and there is absolutly nothing you can do about that.

Dazu habe ich ja gerade ein entsprechendes Angebot gemacht, ein paar Posts zuvor.

Holger will es aber so:

- Ich gebe meine cmsimple-xh Domains ab
- CMSimple_XH behält aber die cmsimple Domains

Das würde aber die Verwirrung nicht auflösen. Eine saubere Lösung scheint von der Community nicht gewollt, also wird das Durcheinander wohl leider bestehen bleiben, denn diese Variante:

Afaik GPL3 is about code, not about names. Even the name "GPL" is protected under copyright. You are not allowed to change something in the GPL-text and use a name, e.g. GPL v.3.1.

The code of CMSimple is GPL=free. So why did Gerd pay the equivalent of a Romanian car to Peter Harteg? He bought the name. Harteg allowed the use of the name with certain restrictions. Gerd also does.

The problem is, that we all have put a lot of energy into this, so our egos also want to be recognized. Thus the problems start. If we could put our egos a bit to rest, it would be easier.

Personally I believe, your project would benefit, if you name it:
CMSimpleClassic
and if you call the downloads
cmsimpleclassic_3-5.zip etc.

Hi Oldnema,

I respect your point of view. You make templates for free, it's your hobby. You can "take it easy".

For me CMSimple is an investment, and webdesign is my profession. I have to care for my project, my family expects it.

Therefore, this discussion have to be brought to an end (result).

I not have decided, to make the discussion public, my first step was writing a mail by Björns mailform, but there was no response,

You asked me if I wanted to stick with it. And my answer was I don't.

But before I change anything I want so see, that you accept the terms in GNU GPLv3. You have bought the copyright to a project released under GNU GPLv3 so you have to accept the rights other people get under this license. You have not bought a trade mark, so nothing give you the right to try to enforce restrictions on name or version numbers.

Of course we should all agree to some sensible rules so we avoid confusing users of CMSimple. But you got no rights to force or bully people to follow your rules.

Even it is not my business I'm surprised to learn that you yourself seem to have sort of hijacked CMSimple_XH as domain mame. If you want fair play from others you better play fair yourself.
